Your Role

  • As a Compliance Manager (AML and FAIS) you will ensure that the Company operates within the legal and regulatory framework relevant to its industry/territory,thereby mitigating risks and protecting the Company from potential legal and financial liabilities.
  • The Compliance Manager (AML and FAIS) is responsible for developing and implementing mechanisms which support the:
    • Monitoring of adherence to key risk legislation;
    • Day to day compliance in the areas of anti-money laundering (AML) regulations, counter-terrorism financing (CTF) laws, sanctions regulations;
    • Day to day compliance operations of FAIS compliance and Market Conduct;
  • This role includes the continuous assessment of Company practices, identification of areas of improvement, and providing guidance and training to employees on compliance matters.
  • The role furthermore requires the Compliance Manager (AML and FAIS) to ensure that Know Your Client, Know Our Supplier, FIC related monitoring processes are implemented, enhanced, recorded and reported as required. to relevant authorities.

What You’ll Do

Governance:

  • Draft, review manage and execute compliance policies, frameworks and procedures within the scope of the department’s responsibilities which govern the Group’s operations.
  • Provide operational support to relevant committees, ensuring management and oversight.
  • Ensure implementation of relevant governance initiatives assigned to you.

General Compliance Risk Management: Risk Identification and Assessment; Risk Controls Assessment; Monitoring; Training; Reporting and Analysis

  • Document and maintain compliance programmes for key legislation – identify obligations and level of compliance with action plans to mitigate or close any non-compliance.
  • Develop and implement action plans to close any identified compliance gaps and provide Dashboard reporting to relevant committees.
  • Develop and implement an annual monitoring plan based on key risk themes and or high risk obligations.
  • Continuous compliance improvements – Implement control mechanisms, such as audits and self-assessments, to detect and prevent non-compliance.
  • Develop, maintain and implement an annual compliance training plan.
  • Compile and deliver internal and external compliance reports.

Legal Regulatory Monitoring:

  • Analyse current and forthcoming regulations, white papers, bills and legislation and provide meaningful, detailed analysis.
  • Ensure that all identified regulatory and compliance risks emerging are communicated to internal stakeholders, risk are identified, managed, mitigated and reported on.

Stakeholder engagement:

  • Promote the brand of Compliance as “trusted business partner/advisor” by building meaningful relationships, relationship management and interaction/collaboration with internal stakeholders to ensure all compliance related matters are brought to the CO’s attention and resolved accordingly.
  • Engage and attend workgroups with external stakeholders such as FIC, FSCA, PASA, Payments Industry Body, Intergovernmental Fintech Working Group as well as with the Regulatory Authorities.

Compliance Administration:

  • Monitor, respond andaction, as required, all matters received via any communication platform.
  • Ensure relationship and all relevant certificates such as (including but not limited to) FSP, SO and TPP are current and up to date with the relevant regulators.
  • External regulatory reporting.

AML, TF, Sanctions & Other Compliance Systems & Functions:

  • Drive FICA compliance across the legal entities in South Africa, as may be applicable.
  • Keep the ARC informed of developments in RMCP, potential risks and vulnerabilities, applicable impending legislation and impact on overall health of program.
  • Manage the Alliance Banking partner relationship from an AML perspective and ensure management of SLA’s and RMCP.
  • Roll-out and monitor the implementation of the RMCP program and provide input into the same as part of the enhancement process.
  • Ensure that compulsory regulatory reporting is submitted and/or reported to the FIC.
  • Ensure the technical implementation of all KYC/ KYB/ EDD requirements in respect of alliance banking relationship and internal requirements.
  • Oversee and implement an ongoing AML Training program for employees.

FAIS and Market Conduct:

  • Work with the external FAIS Compliance Officer to ensure compliance with the FAIS Act and related, financial services legislation and market conduct regulation.
  • Establish and maintain juristic representatives programs based on business requirements.
  • Establish, implement and maintain a Market Conduct Programme based on business requirements, including but not limited to Product Governance, Product Disclosure and related risk management.

Compliance Investigations and Audits:

  • Oversee and assist with any internal compliance related investigations.
  • Support and where required, oversee any external regulatory investigation or audit, including but not limited to FSCA, FIC and NPSD Audits.

 

What We’re Looking For

Qualification & Experience:

Compulsory:

  • Qualification in a related field, such as law, commerce, compliance or risk management.
  • FAIS RE 1
  • 5+ years working experience in a compliance function in Financial Services with working knowledge of FICA and FAIS.

Advantage:

  • Post Graduate certification or diploma in Compliance Management will be advantageous.
  • Preference will be given to candidates who have completed RE1 (advantageous) and RE5 (required) and/or meet the requirements of a FAIS Compliance Officer.
  • ACAMS certification will be advantageous.

Skills & Knowledge Required:

  • Must have in-depth knowledge and experience on the Financial Intelligence Centre Act (FICA) and related anti-money laundering legislation.
  • In-depth knowledge and experience on the Financial Advisory and Intermediary Services Act (FAIS) related notices, financial services legislation and market conduct regulation. Ideally, working knowledge of payments industry protocols and best practices.
  • Knowledge of anti-bribery and corruption laws and regulations.
  • Knowledge of data privacy and protection laws and regulations.
  • Knowledge of Know Your Customer (KYC) and Know Your Business (KYB).
  • Ability to draft, review and enhance compliance and related governance policies and policy management.
  • Comfortable with technology and sharing platforms.
  • A team player with a flexible approach.
  • Works meticulously always demonstrating an exceedingly high level of attention to detail.

  • The ability to multitask and handle stress.
